General Terms of Use of the Website

1. General Provisions

These General Terms of Use (hereinafter: the “Terms”) govern access to and use of the website www.bluesunhotels.com, its content and available functionalities (hereinafter: the “Website” or the “Bluesun Website”).

The Website is operated by SUNCE HOTELI d.d. za turizam i ugostiteljstvo, Radnička cesta 43, 10000 Zagreb, Croatia, Personal Identification Number (OIB): 06916431329 (hereinafter: the “Company”).

These Terms apply to the use of the Bluesun Website and do not replace the terms and conditions governing reservations and the provision of individual services. Reservations for accommodation and other services are subject to the terms and conditions specified in the selected offer and during the booking process. The provider of the particular service is identified in the offer or booking documentation.

2. Use of the Website

Users must use the Website in accordance with applicable laws and regulations, these Terms and the intended purpose of its functionalities.

The following activities are prohibited:

• disrupting or compromising the operation, security or availability of the Website;
• accessing or attempting to access parts of the system, data or content that the user is not authorised to access;
• introducing or transmitting malicious computer code;
• misusing contact forms, the booking system or other functionalities by taking actions intended to disrupt their operation or prevent other users from using them;
• impersonating another person or using another person’s data without authorisation, including the unauthorised use of another person’s personal data or login credentials;
• using the Website’s content in a manner that infringes the rights of the Company or third parties.

When submitting enquiries and using the Website’s functionalities, users should provide accurate information necessary for handling their requests.

The name “Bluesun” and the associated logo are protected by registered word and figurative trade marks. Accommodation prices and availability depend, among other things, on the selected property, dates, number and ages of guests, type of service and terms of the selected offer, and may change before the reservation is confirmed.

Before completing a reservation, users should check the details of the selected services, dates of stay, number and ages of guests, total price, payment and cancellation terms, and any other terms and conditions applicable to the reservation.

5. Display of Offers Through Connected Digital Services

Information on the services offered, including prices and availability, may also be available through connected digital services, including services that use artificial intelligence.

Where a user is directed to the Bluesun Website through such a service, the user completes the reservation on that Website, checking the details and accepting the terms and conditions displayed during the booking process. A conversation with a digital assistant or the display of an offer through such a service does not, in itself, constitute a confirmed reservation.

6. Website Availability and Liability

The Company takes reasonable measures to ensure the secure and proper operation of the Bluesun Website but cannot guarantee its uninterrupted availability or operation without technical difficulties.

Access to the Bluesun Website or individual functionalities may be temporarily restricted due to maintenance, upgrades, security reasons or technical issues.

The Company is liable for damage arising in connection with the use of the Bluesun Website in accordance with applicable laws and regulations. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable laws and regulations, or restricts consumers’ statutory rights.

The Bluesun Website may contain links to third-party websites and services. Their use may be subject to the respective providers’ separate terms and conditions and privacy notices.

The inclusion of a link does not, in itself, mean that the Company operates the linked website or service or endorses all of its content. This provision does not affect the Company’s liability for its own obligations and services.

Information on the processing of personal data, the purposes and legal bases of processing, and data subjects’ rights is available in the Privacy Policy published on the Bluesun Website.

Information on the use of cookies and the management of cookie settings is available in the Cookie Notice or the relevant section of the Website.

These Terms do not, in themselves, constitute consent to the processing of personal data or the use of cookies.

9. Amendments to the Terms

The Company may amend these Terms to reflect changes in laws and regulations or in the Website’s content or functionalities. The current version is published on the Website together with its effective date.

Amendments apply to the use of the Website from their effective date and do not alter the terms and conditions of reservations that have already been confirmed.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. This choice of law does not deprive consumers of the protection afforded to them by mandatory provisions of the law that would have applied in the absence of an agreed choice of law.

If a dispute cannot be resolved amicably, jurisdiction shall be determined in accordance with applicable laws and regulations.
